Leases: freezing of prices and suspension of evictions for non-payment

In the framework of the health emergency, a new Decree of Necessity and Urgency (DNU No. 320/2020) was issued:

- It suspends evictions for non-payment and ordered releases.

- It extends the term of the lease contracts, with the tenant's agreement.

-It provides for lease monthly prices to be kept without increase at the price of the lease regarding

March 2020.

- The debt for non-payment will be paid, as from October 2020 on, in 3 to 6 installments with

compensatory interest and without penalties.

- It orders compulsory mediation, prior to going to court, for disputes between the lessor and

lessee.

- All these provisions apply to the following lease agreements regarding real estate:

1. Single urban or rural housing.

2. Room contracts for family or personal housing in pensions, hotels or other similar

accommodation.

3. Contracts for cultural or community activities.

4. Rural real estate contracts for small family productions and small agricultural productions.

5. Contracts rented by people adhering to the single-tax regime (Monotributo), intended for the

provision of services, commerce or industry.

6. Contracts rented by self-employed professionals for the exercise of their profession.

7. Contracts for properties rented by micro, small and medium-sized companies (MiPyMES)

intended for the provision of services, commerce or industry.

8. Contracts rented by work cooperatives or recovered companies registered within the NATIONAL

INSTITUTE OF ASSOCIATIVISM AND SOCIAL ECONOMY (INAES).
